TERMS AND CONDITIONS OF SUBMISSION
OF CV'S AND WEBSITE USE
GENERAL
These Terms and Conditions govern the use of the website www.premier-engineering.co.uk.
There are also specific Terms and Conditions which relate to the
submission of your information by CV, which are contained below.
When you use the site, all the services offered on the site
("Services") you agree to be bound by these Terms and Conditions. Premier Engineering Corporation Limited
("Premier") reserves the right to alter these terms from time to time.
If you use the Services or access the site, or submit your CV after
any change has been made to these Terms and Conditions, you agree to accept and
be bound by the Terms and Conditions operating at the time.
If you do not agree to the
Terms and Conditions, then you should not use the Services and you should cease
accessing the website.
No variation, amendment or changes to these Terms and Conditions are
valid unless agreed directly between you and Premier in writing.
TERMS AND CONDITIONS OF SUBMISSION OF CVS
1. These Terms set out the basis
on which you agree to submit your CV or other personal information to Premier
and the circumstances under which Premier may use this information.
2. You acknowledge that in
submitting your CV you have checked the information that you have submitted and
confirm that the information is true, accurate and not misleading.
3. You acknowledge that the
purpose of the submission of your CV is for prospective contractors and other
parties to examine the content in order to make a decision on whether they wish
to employ your services, in whatever capacity, be it sub-contractor, employee
or in relation to any contract.
4. You acknowledge that
prospective contractors will be basing their decision on whether to
sub-contract jobs either directly to you, or to employ Premier to provide
services to them on the basis of the information on which you have given in
your CV and that if any of the information on that CV is found to be inaccurate
you may be liable to that contractor.
5. By submitting your CV you grant
Premier the right to retain the CV on its records for a period of 3 years from
the date of submission. Premier
undertakes to destroy this copy of your CV at the end of that period. Notwithstanding this, if, at any time you
request Premier in writing to remove your CV from its database, then Premier
will do so.
6. It is a condition to the
granting of any contract by Premier to you that you give Premier the right to
retain your CV on its records and to provide copies of that CV to any
prospective contractor who may wish to contract with Premier in respect of any
work. You therefore authorise Premier to
give to any prospective contractor a copy of your CV.
7. In addition, Premier is
occasionally approached directly by contractors who wish to contract directly
with a sub-contractor, or who may wish to employ your services in any capacity,
including full time services as an employee.
In these circumstances you grant Premier the right to release your CV to
any such potential contractor or employer for so long as your CV remains on
Premier's database.
8. Please note that in submitting your CV you undertake not to provide
any banking information and, if you do so, this information will be provided by
you at your own risk.

USE
1. Introduction
These
terms and conditions apply to your use and accessing of the website. By accessing the website you agree to the
terms and conditions contained below.
2. Your Obligations
2.1 When using the site you
undertake that you will not do or suffer to be done any of the matters below:
a) you will not interfere with or
limit or prevent any other person from using the website;
b) you will not cause or suffer to
be posted or transmitted through or in connection with the website any
unlawful, defamatory, obscene,
pornographic, profane, threatening, abusive, offensive, derogatory or other

f) copy or reproduce or otherwise
or exploit any of the information contained on the Website for commercial
purposes or, in respect of the Services, any of the information relating to
those Services the intellectual property of which is owned by Premier.
2.2 In using the Website and/or the
Services, you understand and accept that if you do not abide by the Terms and
Conditions contained in this document, you may be liable for any damage or loss
suffered by Premier.
3. Premier's rights to monitor the Website
and the Services
In accessing the Services you acknowledge that Premier has the right
to monitor activity on their Website and that Premier, when required to do so
by any law, regulation, order or other direction given by any responsible
government authority, will disclose such information as may be required and
permitted in terms of that law, regulation, order or request.
4. Premier's Obligations
4.1 Premier hereby undertakes not
to disclose any private communication generated through the Website provided
that that communication has been made by you for legitimate and permitted
purposes in connection with the Website or the Services, subject only to
Premier's obligations to abide by any law or regulation which may compel it to
disclose that communication.
5. Liability of Premier
5.1 Premier does not guarantee that
the Services or the Website will be open for use at any particular time and
that the Website may be closed, or access restricted, whether for maintenance
or for any other reason, at Premier's entire discretion.

to any claim, is therefore excluded from this contract. All liability is excluded by Premier to the
fullest extent permissible at law.

any changes and any such changes to the Website will be made at Premier's
entire discretion.

would enable you to access those third party websites directly from Premier's
Website. These are provided for the
purposes of convenience only and Premier will not be liable to you in respect
of any matter arising from or in connection with the provision of those
hyperlinks including, without limitation, any claim that those hyperlinks are

material which is objectionable to you.

accessing the Website, you understand and accept that communications may be

These Terms and Conditions, and the Terms and Conditions of the submission of the CV set out below are governed by the Laws of England and Wales and are subject to the jurisdiction of the English Court, to whose jurisdiction you hereby consent.
